Claims Avoidance
Review
KEI’s people have performed pre-bid claims avoidance/cost containment reviews on numerous construction contracts ranging in value up to $377,000,000 on the $10 billion Central Artery/Tunnel Project in Boston, Massachusetts. This involves reviewing construction contract plans and specifications during design and contract formation to identify areas with high potential for claims and change orders, and then working with design, procurement, construction, engineering, and owner representatives to develop mitigative measures prior to bid opening. After contract award, all of KEI’s Claims and Change Order Analysts, Schedule Analysts, and Resident Engineers continually monitor the progress of the construction contracts to which they are assigned, performing look-aheads to ensure early identification and resolution of any issues which may lead to contractor claims. These individuals are also continually focused on completing merit determinations for issues as quickly as possible, and reaching fair and equitable settlements as quickly as possible for issues that have been determined to have merit. Our people also know that fostering a good professional relationship with the construction contractor, ensuring fair and equitable treatment of the contractor within the bounds of the contract, and ensuring that the contractor receives timely payment for work performed, all help to minimize the number of contractor claims received on a project. |
